1. Operator and scope
AcrossEstate is a platform operated by Black Coast Capital LLC.

These Terms of Use govern the use of AcrossEstate's public and account-based functions by private users. Professional developers, brokers, sellers, distribution partners and other business providers are also subject to the Partner Terms.
2. Purpose of the platform
AcrossEstate is a digital real estate, information and intermediation platform. It may provide project and unit listings, search and filter functions, maps, saved items, comparisons, project documents, user accounts, real estate inquiries and digital calculation or scenario functions.
The scope of functions may change as the platform develops. No payment obligation arises unless a specific paid service is expressly offered as such and ordered by the user.
3. Role of Black Coast Capital LLC
Black Coast Capital LLC operates AcrossEstate and may also act for individual projects as a broker, distribution partner, listing partner, intermediary or advisory partner.
For certain projects, Black Coast Capital LLC may hold exclusive distribution or marketing rights for particular countries, regions, customer groups or distribution channels under its own agreements with developers. A relevant special role is disclosed in connection with the project.
Operating the platform does not mean that Black Coast Capital LLC is automatically the seller, builder or developer of every property displayed on AcrossEstate.
4. Developers, sellers, brokers and other partners
Properties and projects displayed on AcrossEstate may originate from different developers, sellers, brokers or other professional partners. The relevant developer or seller is responsible for its own services and the contractual obligations it assumes.
A broker or distribution partner may be responsible for advice, intermediation, availability information, communication or sales services. The specific allocation of roles is determined by the presentation of the relevant project and the subsequent contractual documents.
5. No property purchase agreement through mere platform use
Viewing, saving or comparing a project, downloading or requesting information, using a calculator or submitting an inquiry does not by itself create a property purchase agreement.
A purchase agreement is concluded only by a separate legally effective contract with the relevant seller or other contracting party. The specific contractual documents govern the purchase price, payment terms, transfer of ownership, completion, warranties and other rights and obligations.
6. Registration and user account
Certain functions may require registration. Users must provide accurate and current information and appropriately protect their login credentials.
A personal account may generally be used only by the person for whom it was created. Identity misuse, trading accounts and unauthorised use of another person's credentials are prohibited.
AcrossEstate may require reasonable security and verification measures where necessary to protect users, accounts, documents or the platform.
7. Minimum age
Public content can generally be viewed without registration.
Registration of a regular user account and active use of functions intended to initiate real estate transactions, submit individual real estate inquiries or use future payment-related services are generally intended for adults.
8. Formation of the user agreement
Where registration creates a user agreement, electronic formation generally involves entering the required registration information, the opportunity to review and correct it, access to the applicable Terms of Use and privacy information, acceptance of the Terms of Use, electronic submission and, where applicable, confirmation of the email address or another authentication step.
Successful account creation or activation is confirmed electronically or displayed within the platform. Input errors can be corrected through the provided fields before final submission.
9. Records and language versions
AcrossEstate may document acceptance of the Terms of Use together with the user identifier, document version, language version and timestamp.
Maintained legal versions are provided in German, English and Georgian. The English version may be displayed for other interface languages.
10. Project information and sources
Project information may come from developers, sellers, brokers, distribution organisations, official documentation, public registers, public sources and AcrossEstate's own research and preparation.
AcrossEstate may display sources, update dates and verification indicators. Not every item of information is independently verified to the same depth.
11. Verification indicators
AcrossEstate may review developers, partners, projects, construction sites or individual data points. Labels such as checked, verified, site visited, data checked or similar wording refer only to the described scope and date of the relevant review.
Such a label is not a guarantee that all legal, technical, construction, economic or factual risks have been excluded.
12. Prices, availability and currencies
Displayed prices, entry prices, price ranges and availability may change at short notice. A displayed unit is not reserved or guaranteed to be available merely because it appears on the platform.
The price and availability confirmed by the responsible seller or partner before contract conclusion are decisive.
Currency conversions are for orientation. Rounding, delays and differences from actual payment or bank exchange rates are possible. The currency agreed in the specific contract is decisive.
13. Completion, construction progress and permits
Information about construction start, project status, progress, completion, handover or commissioning reflects the information available at the relevant time. Plans and target dates may change.
Unless Black Coast Capital LLC expressly provides its own legally binding guarantee, AcrossEstate does not guarantee a completion or handover date stated by a developer or seller.
14. Payment plans, financing and taxes
Deposits, instalment models, payment plans or financing information displayed on AcrossEstate are project-specific information and do not constitute a general financing commitment by AcrossEstate.
Tax consequences depend on personal circumstances, residence, the property, transaction structure and applicable law. AcrossEstate does not provide individual tax advice.
15. Real estate inquiries and lead routing
A real estate inquiry is first recorded and organised through AcrossEstate under the responsibility of Black Coast Capital LLC.
Where Black Coast Capital LLC is identified as the responsible project partner, the inquiry may be assigned internally to the relevant Black Coast Capital LLC team.
Where another developer, broker, seller or distribution partner is responsible, the inquiry and the information necessary to handle it may be forwarded to that partner. The responsible party should be displayed as transparently as reasonably possible in the project or inquiry process.
Submitting an inquiry does not create a right to reservation, availability, financing, conclusion of a purchase agreement or a specific response time.
16. Documents and project materials
AcrossEstate may provide brochures, floor plans, price lists, payment plans, technical documents or other materials. Certain documents may be available only to registered users or after approval.
Documents may originate from third parties and have their own update date. Final contractual documents must be reviewed before signing.
17. Calculators, scenarios and comparisons
Digital calculators, scenarios and comparison functions are intended to structure and illustrate assumptions. Results depend on inputs, data dates, model assumptions and rounding.
They are not forecasts, commitments or guarantees of value appreciation, rental income, occupancy, return, resale price, tax burden or other economic outcomes.
18. No individual investment, legal or tax advice
General information on AcrossEstate does not replace individual legal, tax, financial or other professional review. Users are responsible for engaging suitable independent advisers before a material decision where appropriate for their circumstances.
19. User obligations
Users may use AcrossEstate only lawfully and for its intended purpose. In particular, they may not use false identities, circumvent security systems, use other persons' accounts, introduce malware or manipulate platform functions.
Project documents and personal data may be used only to the extent legally permitted and intended.
20. Prohibited automated use
Systematic scraping, automated mass access, circumvention of technical safeguards, unauthorised data collection and automated use that excessively burdens systems or infringes rights are prohibited unless such use is mandatorily permitted by law or expressly authorised.
21. Intellectual property
Trademarks, software, design, databases, texts, graphics, photographs, videos, floor plans, documents and other content may be legally protected.
Users receive only the right to use AcrossEstate and its content for the intended personal purpose. Further reproduction, publication or commercial exploitation requires a legal entitlement or permission from the relevant rights holder.
22. Professional partner content
AcrossEstate may host and publish information and materials supplied by professional partners. Partners remain responsible for the content they provide in accordance with applicable law and the Partner Terms.
AcrossEstate is not required to fully verify every third party item before publication. Specific issues brought to its attention may be reviewed and moderated where appropriate.
23. Moderation and restrictions
AcrossEstate may restrict, correct, hide, disable or remove content, listings or accounts where there is an objective reason, including illegal content, infringement of third party rights, demonstrably or manifestly misleading information, security or fraud risks, breaches of the Terms of Use or Partner Terms, or requirements from courts or public authorities.
Moderation decisions may be supported by technical security mechanisms and human review. AcrossEstate currently does not use artificial intelligence to make legally binding assessments of users.
24. Reporting potentially illegal content
Specific content may be reported electronically to legal@acrossestate.com.
A notice should, where possible, include a reasoned explanation of the alleged illegality, the exact electronic location, especially the URL or unique content reference, any additional information necessary to identify the content, contact information of the notifying person where required and a statement that the information is accurate and complete to the best of the notifying person's knowledge.
AcrossEstate may request further information if a notice is insufficiently specific. Where applicable law imposes specific notice-and-action requirements, those requirements will be observed.
25. Decisions concerning reported content
Depending on the outcome of the review, AcrossEstate may take no action, correct or supplement information, restrict visibility, temporarily disable content, remove content or restrict an account.
Where required by law, affected persons will be informed of material decisions, reasons and available complaint or redress options.
26. Sorting, recommendations and rankings
Search results and projects may be sorted or displayed based on user filters, search relevance, location, price, completion, availability, data quality, completeness, freshness, editorial relevance and, where applicable, contractually agreed promotion.
A high ranking is not a guarantee of quality, return, safety or suitability for a particular user.
27. Sponsored and promoted content
Paid or otherwise commercially promoted content is identified, where required, in an understandable manner as sponsored, advertising or similar. Commercial promotion is not presented as an independent quality assessment.
28. Technical availability
AcrossEstate seeks to operate reliably. Continuous or error-free availability cannot be guaranteed at all times. Maintenance, security measures, technical incidents, third party services or events outside reasonable control may temporarily affect operation.
29. Changes and development
AcrossEstate may add, change or discontinue functions where reasonable in light of existing contractual rights and user interests. Material changes to a contractually promised service will be handled in accordance with applicable information and contract requirements.
30. Future paid functions
AcrossEstate may offer paid functions in the future. These Terms of Use alone do not create a payment obligation.
Before a paid order is placed, the scope of service, total price or calculation method, payment terms, duration, termination and legally required consumer information will be clearly displayed. Any applicable withdrawal right or other mandatory consumer right is not excluded by these Terms of Use.
31. Liability
The liability of Black Coast Capital LLC is governed by applicable law. These Terms of Use do not exclude liability that cannot lawfully be excluded or limited.
AcrossEstate does not guarantee, in particular, that information supplied by third parties is complete and current at all times or that a real estate project will achieve a particular economic outcome. Specific inaccuracies that become known may be reviewed and appropriately corrected.
32. Restriction and termination of user accounts
AcrossEstate may proportionately restrict or suspend an account where there is an objective reason, including a material or repeated breach of these Terms, suspected fraud or security threats, illegal use, misuse of data or documents, attacks on the platform or a legal or regulatory obligation.
Users may request account deletion subject to the available functions, applicable retention duties and the Privacy Policy.
33. Changes to these Terms
AcrossEstate may amend these Terms of Use due to legal, technical or business changes. Material changes affecting an existing contractual relationship will be communicated in the form and within the period required by applicable law.
Where renewed acceptance is legally or contractually required, continued use of certain account functions may depend on such acceptance.
34. Applicable law and mandatory consumer rights
These Terms of Use are generally governed by the law of Georgia.
For consumers, mandatory protective provisions of the country of their habitual residence remain unaffected where they apply mandatorily under applicable conflict-of-laws rules and cannot validly be excluded.
35. Disputes and contact
Questions and complaints may be sent to support@acrossestate.com or legal@acrossestate.com.
Statutory rights, competent courts, authorities and legally available remedies remain unaffected. No exclusive jurisdiction clause applies to consumers where such a clause would be invalid under applicable law.
36. Changes, language versions and severability
AcrossEstate maintains German, English and Georgian versions. The English version may be displayed for other interface languages. The language versions are intended to have the same regulatory meaning and are interpreted according to their common purpose subject to mandatory law.
If any provision is wholly or partly invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law. Applicable statutory rules apply in place of an invalid provision.
